Below you will find the terms and conditions of Josh Frost Entertainment. These terms apply to all performances, workshops and other services we arrange together.

1. General

1.1

These terms and conditions apply to all agreements concluded between Josh Frost Entertainment and the client, concerning all services offered (workshops, performances, character acts), hereinafter referred to as the ‘performance’.

1.2

Deviations from these terms and conditions are only binding when they have been confirmed in writing (on paper or by e-mail) by Josh Frost Entertainment.

1.3.1

An agreement has been concluded and is binding once the contract drawn up by Josh Frost Entertainment has been signed by the client and the signed copy has been received back by Josh Frost Entertainment.

1.3.2

A signed copy of the agreement received by Josh Frost Entertainment is confirmed by Josh Frost Entertainment by e-mail, and the agreement is thereby entered into.

1.3.3

Changes to the agreement must be recorded in writing in a new, replacing agreement. Articles 1.3.1 and 1.3.2 must then be carried out again.

1.3.4

Inaccuracies in the location, (waiting) time or of any other nature recorded in the agreement must be made known to Josh Frost Entertainment by the client before signing. Josh Frost Entertainment will then provide a new, amended agreement.

2. The performance

2.1

Arrangements regarding the performance, as recorded in the agreement, are binding. Extending the performance is possible at an additional charge, provided this is indicated well in advance.

2.2

The Client must provide the necessary facilities (parking, dressing room), working space and time, so that Josh Frost Entertainment can properly prepare on site and pack up calmly.

2.3

The Client is liable for damage to and/or loss of material belonging to Josh Frost Entertainment during the preparation, the performance and the breakdown up until the departure of the artist, unless caused by the artist themselves.

2.4.1

For performances of four hours or longer, the Artist is entitled to a 10 minute break per hour.

2.4.2

A room is available for the Artist to withdraw to during their break.

2.4.3

If a performance has to be ended or interrupted due to circumstances (weather or danger), the fee must still be paid in full by the Client at all times.

2.4.4

In the event of a disagreement regarding the ending or interruption of a performance, the opinion of the artist is decisive.

2.5

During the presence of the artist, the artist is entitled to free refreshments, proportionate to the length of their stay.

2.6

Any waiting time for the artist that arises and has not been recorded in the agreement is charged on top of the agreed invoice amount.

2.7

Fines incurred by the artist as a result of incorrect instructions from the Client (for example regarding parking) fall under the liability of the Client.

3. Cancellation by the client

3.1

The client may cancel a performance in writing, by letter or e-mail.

3.2

A performance is only cancelled once the cancellation has been confirmed by Josh Frost Entertainment.

3.3.1

In the event of cancellation up to four weeks before the performance date, only administrative costs are charged.

3.3.2

In the event of cancellation within four weeks of the performance date, 50% of the agreed costs as shown on the invoice are charged.

3.3.3

In the event of cancellation within 7 days of the performance date, 75% of the agreed costs as shown on the invoice are charged.

3.3.4

Cancelling when the artist is already en route to the performance results in the full invoice amount being charged.

3.3.5

In the event of force majeure, to be determined by Josh Frost Entertainment (for example death or serious illness), Josh Frost Entertainment will not charge any cancellation costs.

4. Cancellation by Josh Frost Entertainment

4.1

Josh Frost Entertainment has the right to cancel a performance in the event of force majeure (death, illness, accident, car trouble). Where possible, the Client must be given a clear reason. In such cases the Client is entitled to a full refund if payment has already been made in advance.

4.2

Josh Frost Entertainment takes responsibility and will, in the event of force majeure, aim to arrange suitable replacement. No rights can be derived from this.

4.3

After cancellation, Josh Frost Entertainment is not further responsible for any other costs incurred by the Client.

5. Payment

5.1

Agreed costs are charged by Josh Frost Entertainment by means of an invoice.

5.2

From the moment of invoicing, the client has 14 days to pay the invoice.

5.3

If the Client does not pay the invoice within the term, one free reminder is sent, with a renewed payment term.

5.4

If the Client does not meet the payment obligation within the payment term, interest of 5% per week is applied. Each new week counts as a full week, starting on the day on which payment was due.

5.4.1

If a payment from the Client to Josh Frost Entertainment is not made within the term, any collection costs are necessarily passed on to the Client.

5.4.2

Additional administrative costs incurred by Josh Frost Entertainment are also passed on to the Client.

5.4.3

If, in the event of non-payment, Josh Frost Entertainment decides to hand the claim over to a third party, all costs thereof (such as judicial and extrajudicial collection costs, legal assistance, costs not awarded by the court, and without prejudice to VAT and any litigation and enforcement costs) are borne by the Client.

6. Copyright and portrait rights

6.1

Copyright applies to all performances and documents and to the website of Josh Frost Entertainment.

6.2

By taking part in an activity, participants agree to the use of media material collected during a performance.

6.3

Participants may take photos or video material themselves, provided this is for personal use. For distribution, this must first be approved with written permission from Josh Frost Entertainment.

6.4

Josh Frost Entertainment reserves the right to request and obtain recorded material free of charge from the Client and from third parties, and to use it for its own promotional purposes.

7. Liability

7.1

Josh Frost Entertainment undertakes to perform at all times to the best of its knowledge and ability.

7.2

Participation in performances or activities in which Josh Frost Entertainment is involved is entirely at your own risk.

7.3

Josh Frost Entertainment is not liable for indirect damage to the Client arising from a performance.

7.4.1

Josh Frost Entertainment reserves the right, for itself and for the artist, not to let a performance take place if the Client does not comply with the agreed arrangements.

7.4.2

In the situation described in 7.4.1, the Client remains obliged to pay the agreed invoice.

This is an English translation of the Dutch terms and conditions. In the event of any difference in interpretation, the Dutch version prevails.
